What is the EUDR?

In this chapter we will explain what the EUDR is.

Regulation 2023/1115 of 31 May 2023 on the making available on the Union market and export from the Union of certain commodities and products associated with deforestation and forest degradation (“EUDR” for short) requires operators and traders to take various compliance measures when placing and making available on the Union market and exporting from the Union relevant products containing relevant commodities. In addition, Commission guidelines can provide support for the implementation of the EUDR, such as the Commission Communication (C/2024/6789). These contain, among other things, interpretation aids and example scenarios. 

According to Art. 3 EUDR, relevant raw materials and relevant products may only be placed on the market or made available on the market or exported if all of the following requirements are met by each individual supplier beforehand:

  •     they are deforestation-free, 
  •     they have been produced in accordance with the relevant legislation of the country of production and 
  •     they are covered by a due diligence declaration. 
In addition, operators and traders must, in accordance with Art. 8 EUDR: 

  •     collect information (Art. 9 EUDR) in order to 
  •     ensure that Art. 3 EUDR is fulfilled. 
  •     Carry out a comprehensive risk assessment (Art. 10 EUDR). 
  •     Implement risk mitigation procedures and measures (Art. 11 EUDR).
